Commercial property for sale. Upon sale like to purchase a residence or com.property do u hav 2 pay cap gains?

As long as you are purchasing property that you are using for investment purposes, the way you do this is through a ';1031 exchange';.





The name is a bit misleading, as you don't have to find someone willing to trade properties with you, however, it only works if the property you'll be selling is investment property and the property you'll be buying is also investment property.





It needs to be arranged in advance, and there are some very strict time-lines that must be followed. Talk to your agent, and he/she should be able to go into more detail for you. Most experienced agents have some familiarity with the 1031 process.





If you happen to have a new agent that isn't familiar with 1031 exchanges, ask to bring the broker in on the conversation. (If the broker doesn't understand the basics of a 1031 exchange, it's probably time to go elsewhere.)

FHA provides loans that help many people buy homes at better rates with less money down and any loan officer should be able to tell you if you qualify for a FHA loan. HUD is a US department that also offers foreclosed homes for sale when people with FHA/other gov. loans default on them have them taken back as well as subsidized homes. Real estate brokers have to be registered to bid on HUS homes and there are usually several HUD capable agents in any area. Below is the website for FHA and it is pretty informative. this is the agent's way of pushing up the price. it is currently a seller's market and several buyers go for same properties. it is utterly unfair but estate agents are only interested in their commision and will do anythig to push up the price. be careful if you put in a bid, not much point spending any money until you ve been accepted but unfortunately even then there's no guarantee the seller will go with you.
A sealed bid auction is a type of auction





In a sealed bid auction, each participant submits a secret, or sealed, bid on each of the item to be auctioned.

We attempted to purchase a house using this method a few years ago.





They had an open viewing day and all bids were to be received 2 weeks later.





We knew 2 of the other people who placed a bid.





A Friend of ours was a builder and he placed the highest bid with a view to developing the property.





We placed the second highest bid but needed to sell our property before we would be in a position to proceed and would form a chain.





I know the person who's bid was successful. They bid 拢2000 less than us but were chain free and had their mortgage offer in place and ready to go. They planned to refurbish and have it as their family home.





So its not always the highest bidder that wins.





In my experience its a combination of a good price and being in a good position. Your plans for the property could also be significant.





When you place your bid give as much information as you can to enhance your chances.
It means you are not allowed to know what other offers have been put in and they are not allowed to know your bid either. You submit your offer, along with other who want the property and the highest one is allowed to buy it.





Unfortunately it could mean paying over the odds for the property if you wish to secure it. If you bid too low you'll lose it but how high is high enough when you don't know what others are offering. People may bid OVER the asking price.





Unless you are desperate for this particular property, I'd steer clear! Good luck though

There are far fewer agents and brokers practicing commercial real estate, but the licensing requirements are the same as with residential (A real estate license allows one to practice both Commercial Real Estate and/or Residential Real Estate.)

    For sure, get some land. I woud offer 2 pieces of advise though...





    1. Make sure you purchase through a reputable firm. Otherwise, a random broker may sell you land with fake paperwork and screw you. It pays to spend a bit on a good real estate firm.





    2. Look around. Property prices have been in the rise. Some think a real estate bubble is happening. Just make sure that if something happens in the real estate market, that you won`t feel like you way overpaid!





    Just common sense. Land is a good investment though...

    have you actually seen the property? some of the land is being sold because it can no longer grow anything. i don't know what you want it for, but you need to check into the new laws the Costa Rica government made about purchasing and retiring, relocating there. i have friends who live there that tell me they feel safe , but with so many foreigners moving there they feel unwanted now.
    i know someone who purchased two plots of land there in september. they have already doubled in value! even though there is no military there it is a pretty safe country. good luck!
    Just make sure that your real estate partner is serious. Some properties in Costa Rica have been sold two, three and even four times, since the ';new'; owner does not live in Costa Rica and will not even know what is happening to the property.


    So the old owner will sell it several times and at the end you have to fight against other owners and lawyers that have not registered your property properly.


    Also remember that if you don't do anything with your property during one year (cleaning, planting trees, builindg) and somebody just ';decided'; to build their little ranch there, it will be very difficult (from the legal side) to get this person out of there.


    So make sure that you are making a deal with someone serious and don't leave your property for years without maintenance.





    Real estate is a very good investment in Costa Rica.
    True - but as you can see, property in Costa Rica has climbed a lot in the past 10 years - it is no longer a 'great' deal but if you want to move there, then go for it.
    Go for the one's made out of boxes, or being sold by hobo's those are good.

    There are many local news papers, like Hurriyet, Zaman, Sabah etc.. Frankly I'm not in this business as far as I know people normally depended on banks for personal loan. As you know beggers are not choosers. Your best chances are to target the rich ones in Turkey, to do that you will have to contact Property brokers in Istanbul who is charge you I beleive they know the business..

    No, not really.. don't know what you want the HUD for, so can't help you much. As far as, I can tell that I would be worried about is the 'as is'... And, I would want to get it looked at by county inspectors. Well, maybe two county inspectors and look at it myself, if at all possible.
    yes you buy as is this does not matter if the foundation is broken or if thje whole place is ';red tagged'; stay away from it...youi never know...but ';as is'; is a red flag....please stay away from.

    Northern Manitoba is mostly forests and lakes. Some parts are so remote that you have to fly in. This is not where you want to be for agriculture unless you plan on raising polar bears. It might be a great place to invest if you're willing to wait until the ice melts and they open a major port in Churchill.





    You'd be better off looking in central to southern Manitoba. Most agricultural land is sold parcels of a quarter sections (160 acres) or greater. There may be restrictions on subdivision of farmland.





    I've seen quarter sections with older houses listed for around $80,000 CDN. Some realtors list them as ';hobby'; farms. A ';real'; farm will cost $450,000 or more.

    From where I am, the weather can be completely different in a day trip in the car. The west coast of Oregon is a bit rainy, but with mild temperatures all year. Go a bit inland and it doesn't snow (if it does, it is rare), but has four seasons, and the temperatures can soar into the 100's in summer. In the Mountains, there are some areas that pretty much have snow year 'round. Then there is central and eastern Oregon, where there are four seasons, and very little precipitation in the summer. Long, hot dry summers!

    My husband and I are interested in putting in an offer for a property in Buffalo, NY that was foreclosed and is now for sale. The Village requires an inspection of plumbing, electrical etc to issue a Certificate of Compliance to bring to closing. My question is, if it fails inspection, what happens then? Does the bank have to bring it up to code since they are in possession of the property?     First, In any property negotiation, you can offer whatever you like as a potential buyer. There are no ';rules';, except that the seller may or may not accept it and is free to tell you to go take a hike if they don't like the offer. You could try making the offer with the condition that the property be brought up to code and the bank is free to accept it or reject it. The only problem with that is that you will delay the process for yourself and if someone comes along with a better offer, in this case, someone willing to buy the property and deal with the deficits themselves, the seller will go with them and you will lose the property.





    I sense in your question that you think there may be some law that forces sellers to fix whatever property they are trying to sell. Nope. No such law.





    Each area is different. I am not sure why your local municipality would get involved in stopping a real estate closing. I have never heard of a local government policing real estate closings. You must be talking about what the bank requires. Perhaps you have phrased it incorrectly. Do you mean, instead, that you want to finance this purchase and the bank wants you to get a certificate of compliance from the Village before they'll give you the mortgage? In that case, perhaps your bank will add an escrow account of some kind to fix the problems with the property in lieu of getting a certificate of compliance. If it's a problem with financing, I suspect you could get around it by buying the property for cash, if you have the resources.





    The direct answer to the last question, ';if we include that our offer is valid only if we pass inspection ....'; the answer is obvious. If you make that a condition of closing, the repairs have to be done before the closing, period. That's what you ask for, that's what you get. But I am wondering if you are in fact asking the correct questions.





    In any case, don't be afraid of repairs. I buy and sell houses with no functioning heating systems, broken pipes and much more. You just pay to have them fixed and quickly get your money back when you sell or rent the newly-renovated property.Foreclosed property for sale by a bank fails inspections, what now?
    Anything is possible after the bank has taken it back. The bank is the owner. They need to get it off their books. Some of the time they will sell as is and will not entertain any sort of request for repairs or a credit. The price should reflect the present condition. In other cases the bank will agree to make specific repairs or credit some of the purchase price.





    I have purchased a number of similar properties and it really comes down to what the buyer and seller agree. Some banks will say no but later become more flexible as to repairs. You might prefer to get a credit or price reduction if you want to control how the repairs are completed.





    If you are buying a home that is run down assume the next lender will not offer a loan on the property until the repairs are already completed and signed off by the inspector. A bit of chicken and egg if you do not have private funds.
    this is a very typical negotiating point. Inspection failures are always a topic between buyer and seller. The bank is likely to offer you credits off the price of the house based on the fair market value of the cost of repair. Then the repair becomes your headache. Remember the house is mortgaged for it's purchase price, not it's potential value after the defects are repaired. This means you will have to have sufficient funds on hand to correct the inspection issues. This is esspecially true if any of the repair items will prevent you from getting a 'certificate of occupancy' from the city. Buffalo may call it something different, but you should look into any repair criteria the city may have as mandatory before you move in.
    All boils down to what the rules are in your area. If the property has to be brought up to code before selling it, it will be the bank's business to do so. If not, and you are willing to do the necessary work, you could put in a lower bid to reflect the needed repairs. Best of luck to you.
    When you buy in foreclosure you buy ';as is';. It probably stated that in the foreclosure notice in the paper assuming that this is a sale on the court house steps. Your area may handle sales differently - say the bank takes ownership and resells it, then you could make your offer with the condition that it passes inspection. People in foreclosure can sometimes be quite destructive before leaving.
    You can ask the bank to fix the problems or you can try to reduce your offer and fix problems on your own after the closing. You may want to check with the city about the Certification or Compliance. I do not have much experience with that but you should be able to fix on your own.

    You should also look into the title company that closed the property for you. They are liable if the deed was not clear. Yes, you can cancel the sale based on the fact that the deed isn't clear. Just tell them about it. Few people will try to go to the closing table with a clouded deed. Get in trouble? Bull.     i agree. one of the contingencies of sale of a home is a clear title. i don't see why they are putting this on you. it is the responsibility of the title company, the lender and the escrow company. these people are supposed to take care of any issues. if you can't clear title that is fine but you will not get into any trouble for falling out of escrow. it happens all the time. the realtor is trying to scare you. they maybe in the industry but they don't know all the details. they are not your lender, they are not your title company and they are not your escrow company. they are your realtor. maybe you should consult another realtor and consider switching realtors. you can cancel the sale if it is still in the waiting period.
    Are you selling For Sale By Owner? Why can't you ask your realtor this question? Every brokerage has a lawyer that will answer these types of general questions for you. You get what you pay for!! Also, have you not retained a lawyer in connection with this home sale? If not, are you crazy?





    You don't provide near enough facts to answer your question conclusively so it's difficult to give more than a rule of thumb type answer. I can give you some generalities though.





    First, know that often a buyer likely can't sue you for this unless the contract you signed specifically gives them the right to do so. It's is a contingency like any other in a contract and both parties agree to the terms.





    Second, understand that this is a very common thing to have happen. Every Realtor who does any kind of volume runs into a cloudy title now and then. It's usually not a really big deal but you mention it might take some time to clear your title. Why? What is the cloud? How much time do you need to clear it? If it's a month, then offer to delay the closing and see how they respond, let them kill the deal if they don't like it. If it's a year then ask your lawyer what to do.





    The worst thing that could happen would be you may end up being a nice guy and pay them for their inspection and survey and other stuff but there is no way this should go to court.





    The only way I can see this being bad for you is if you knowingly marketed a home with a untransferrable title. You didn't do that did you? Even if you did they would have to prove you knew, which they couldn't so just kill the transaction and don't worry about it.





    When was the title clouded? Were you tranferred a cloudy title?
    Well, no. Isn't that the point of a search? The sale is contingent upon a clear title search. The title can't be transferred, you were unaware of it. If you kept his/her money then I could see a big problem. Give the money back, get on with your life.


    The Realtor is probably telling you this in the hopes that you will just pay the lien and continue with the sale. It's not that you changes your mind, you can't legally transfer the title.

Be aware especially of companies claiming to charge very small commission rates. I cannot name them for obvious reasons but they usually have a minimum charge of anything from 10,000 euros which most people don't realise.


    I am based inland on the Costa Del Sol approx 30mins from Malaga airport. I work closely with a few Spanish agents who I trust and also I do not work with only one Solicitor, this is to protect my clients interests.


    I have had many ups and downs in Spain and would not let my clients have the same misfortune, this is why I tell it as it is, warts and all.     As others have suggested this require time, energy, money and research. So the answers here are just for starters, you still have a lot to work to do.





    A few points: The problem with FSBO is that your house is not listed on the MLS. Depending on the State you live in, there may be some realtors willing to list your house for a flat fee. You will still have to pay the buyers agent their traditional fee (2.5 - 3%, but that still beats paying both agents the full commission. Web surf regarding flat fee listing services and see if they are applicable to your state. Having said that, there are some downsides:





    1) Even though it's illegal, buying agents hate flat fee listings. If they figure out that your listing is via this route, they may not tell their clients about your house. Note that within the MLS system there is no way to tell if your house is listed as a flat fee arrangement with the listing agency. If a buying agent figures it out, word will spread.





    2) There will be no 'For Sale' Realtor sign out front (although some flat fee realtors will provide you with a sign for a fee. You can't put your own For Sale sign out because that will confuse realtors and they will not bring clients to your house for fear the clients will drop them and go directly to you.





    3) As mentioned before, listing for the flat fee halves the commission you pay, but that means you still pay a buyers agents a large amount of money, simply because they brought a buyer to the table.





    As for going the full FSBO route - you will have to weather numerous b.s. bids from speculators/flippers who always assume that a FSBO is either desparate or stupid, or both. You will likely be harassed by agents looking to list your house for you. There are ways to limit this kind of crap but you can't eliminate it.





    Part of marketing the house outside of a traditional agent will require you to send more on advertising that you might think. Buying a 4 line ad in the largest local paper will not get a big reaction except from speculators. But paying for a larger ad with a pic of the house and more details, and perhaps even creating a website so people can take a virtual tour will help you.





    Also, you will have to organize your own open houses and advertise them aggressively to get people to come. You may want to think about having someone else show the house during an open house event, because buyers are not very comfortable wandering around a house with the owners hovering over them. Interview your Realtors carefully asking them questions on how they promote your home, their sucess rate over the years, are they full time or part time. We did it all ourselves without a lawyer. Check the laws in your state to see what you are responsible for like title searches, radon tests, home inspections, etc. Laws differ by state. Real estate agents will try to talk you out of using this service but we did and saved 35K.
    They traditionally charged 6% of the selling price, with half going to the selling broker, half to the buyers broker.





    The commission is negotiable.





    There are also flat fee no frills brokers that will just charge you x dollars for a listing, but i have never actually seen one of these.





    I dont believe realtors are worth 6%, my personal opinion is to shop around for the cheapest place you can find to put your house on the MLS, I found my last two houses on the internet, and the realtors just try to steer you into something just outside of your price range.





    Realtors are loser, and with internet they are becoming more obsolete than ever.

    As a rule a Realtor does not charge you anything up front for listing your property in the MLS if you are using that Realtor as your sales or listing agent. When you sign up your Realtor you can negotiate the percentage that you will pay out of escrow at funding of sale.


    However, if you are trying to do a FSBO (for sale by owner) then you will probably have to pay for the listing and any other services that they offer for up front fee. Other services could be a listing on a website, information on legal papers needed and so forth.


    In these times it really pays to have people that are interested in buying qualified so you aren't tying up your time and property with someone that can not buy your house. We offer this service for free and can not begin to tell you how much this has helped sellers (also buyers).
    I think when it sells they get 3 or 4 %

    About a month ago, there were news that hotels are on sale the whole of Thailand. Something like 200 hotels nationwide, because of the situation that started from the airport closure, the flu, and etc... Tourist number are declining. So, I guess you are in for a good time if you wanna buy hotels. And, I seriously thing foreigners can own hotels in form of company. Consult your lawyer first because even if the whole loads of hotels are on sale, they're not very cheap either.
    Your need to see a real estate agent in Phuket. However, if you are not Thai your not going to be able to buy property. And even if you could buy property most likely you couldn't afford a wai of land on Phi Phi since you have to ask how much to just travel for 4-5 weeks in Thailand.
